France: the regime governing directors' liability in insolvency and reform perspectives

Assesses the legal regime in France governing the liability of directors of companies that become subject to insolvency proceedings. Discusses key provisions of the Commercial Code 2000, relating to: (1) civil claims, including the extension of procedures and the claim for a contribution; (2) civil sanctions, including personal bankruptcy and disqualification; and (3) criminal sanctions. Comments on reform proposals, focusing on the draft laws produced in 2003 and 2004.
