On the brink of land obligations again
Reviews proposals in the Law Commission's June 2011 report entitled "Making Land Work: Easements, Covenants and Profits a Prendre" to introduce a positive land obligation in the form of a legal proprietary interest, and to extend the role of the Lands Chamber of the Upper Tribunal to prevent land from being overburdened by such obligations. Examines the Lands Chamber's role in discharging and modifying restrictive covenants between 2000 and 2011, and suggests why the practical operation and detail of its revised powers will determine whether the land obligation will succeed.
