The eighth amendment to article 164: window dressing or new era of anti-bribery enforcement?

Considers whether China's eighth amendment to its Criminal Law, criminalising the bribery of foreign officials, is likely to succeed in bringing the country's bribery laws into line with global standards. Examines the challenges which China's culture of gift-giving in business pose for multi-national companies (MNCs) and how China's reforms compare with the provisions of legislation such as the UK Bribery Act 2010. Reviews key features of the Chinese offence, the scope of the available defences and exceptions, the extraterritoriality of the reforms and their implications for Western MNCs.
