Abstract

Theoretical and empirical knowledge on issues related to government procurement in preferential trade agreements (PTAs) is sparse. It consists mainly of taxonomies of legal provisions on government procurement and economic models of across-the-board (i.e., nondiscriminatory or nonpreferential) reductions in discrimination against for- eign bidders for state contracts. To the best of our knowl- edge, no ex post empirical assessments have been conducted on the impact of PTA provisions dealing with government procurement on trade flows or on the effectiveness of national procurement institutions, nor are there evalua- tions of the extent to which these PTA provisions have been implemented or of whether national procurement authori- ties have changed their practices as a result of PTA provi- sions. The analysis of government procurement in PTAs is a nascent discipline, and readers are cautioned accordingly.
The purpose of this chapter is to describe what is known concerning public procurement provisions in PTAs and what factors ought to be taken into account by policy mak- ers and analysts as they evaluate policy options in this area. Although an effort is made to draw appropriate policy implications, the findings are largely tentative and will need to be revised in the light of new evidence and changes in thinking as to what constitutes effective public procure- ment policy.
