Abstract

Determining whether a state measure originates from state sources is a decisive criterion to assess whether a measure is a state aid. This Chapter addresses the case law from an analytical perspective, from the two separate and cumulative criteria: the direct or indirect grant of state resources and the imputability of measures to the state.
