I diritti umani in Russia e Cina: proposte concettuali e rapporti tra ordinamenti
chapter
posted on 2023-06-09, 15:25 authored by Marco Balboni, Carmelo DanisiThis book chapter is a first attempt to explore the issue of human rights in Russia and China drawing comparisons from an international law perspective. To this end, firstly it scrutinises the role and the position of international law within these countries' internal frameworks. Secondly, it analyses the conceptualisation of human rights that emerges from the relations of these countries with the universal human rights framework. Thirdly, combining the related findings, it verifies how human rights are integrated in Russian and Chinese legal orders. It concludes that, in contrast to common belief, both countries do not oppose human rights as such but require that these are interpreted in light of their national identity or strategic aims.
